What is Usufruct?

Usufruct is a real right that allows a person (usufructuary) to use and enjoy someone else's property, receiving its fruits, without being able to dispose of it. At Iurium Consulta we are specialists in succession law and the management of usufructs under the Catalan Civil Code.

Types of Usufruct

Temporary Usufruct
Established for a fixed period of time, after which it automatically expires and the property returns to the bare owner.
Life Usufruct
Lasts for the lifetime of the usufructuary. This is the most common form in inheritances and wills, especially in favour of the surviving spouse.
Widowhood Usufruct
The right of the surviving spouse to enjoy the deceased's property. In Catalonia, the Codi Civil de Catalunya (art. 442-3 CCCat) specifically regulates this right, granting the surviving spouse universal usufruct of the estate.
Bare Ownership
Bare ownership is ownership of property stripped of the usufruct. The bare owner holds title to the property but cannot use it or receive its fruits while the usufruct lasts. When the usufruct is extinguished, full ownership automatically consolidates, and the bare owner recovers full ownership without any additional legal act.

Widowhood Usufruct in Catalonia

The Codi Civil de Catalunya establishes a special regime for widowhood usufruct that differs from the Spanish Civil Code. In Catalonia, the surviving spouse has the right to universal usufruct of the deceased's estate (art. 442-3 CCCat), unless there is a contrary testamentary provision. In addition, Catalan law recognises the 'any de plor' — the right of the surviving spouse to remain in the marital home during the year following the death, even without testamentary usufruct.
