What is Usufruct?
Usufruct is a real right that allows a person (usufructuary) to use and enjoy someone else's property, receiving its fruits, without being able to dispose of it. At Iurium Consulta we are specialists in succession law and the management of usufructs under the Catalan Civil Code.

Widowhood Usufruct in Catalonia
The Codi Civil de Catalunya establishes a special regime for widowhood usufruct that differs from the Spanish Civil Code. In Catalonia, the surviving spouse has the right to universal usufruct of the deceased's estate (art. 442-3 CCCat), unless there is a contrary testamentary provision. In addition, Catalan law recognises the 'any de plor' — the right of the surviving spouse to remain in the marital home during the year following the death, even without testamentary usufruct.
